Auction Terms and Conditions (Version 27.12.2022)

preamble

Auktions- & Pfandleihhaus exclusive GmbH – hereinafter referred to as auctioneer – conducts auctions, with the exception of its own goods, in the name and for the account of its clients – hereinafter referred to as seller/consignor and/or owner, owner – in the order in which they are offered in the catalogue. The auction goods - hereinafter referred to as auction exhibits - are marked according to a lot number procedure. The auctioneer commissions auctioneers to carry out the auctions. The following auction conditions apply to the auctioneer, the seller/consignor, the bidder – hereinafter referred to as the bidder – and the buyer – hereinafter referred to as the successful bidder :


A. General Provisions


  1. Consignors and bidders must present the auctioneer with a valid identity card or passport with an official confirmation of registration. If the auctioneer does not have a valid identity card or a passport with an official confirmation of registration, the business relationship cannot be established.
  2. Taking into account point 7 of these auction conditions, the successful bidder can find out the address of the seller/consignor, and the seller/consignor can find out the address of the successful bidder at any time.
  3. The auctioneer reserves the right to withdraw lot numbers, to separate them, to auction them out of sequence, to exclude certain persons from the auction and to reject written bids.
  4. The inspection and examination takes place before the auction; the location and time can be found in the catalogue. The auction exhibits will be auctioned off as viewed. Complaints to hall bidders are excluded. The auction exhibits are described in the catalog to the best of our knowledge and belief, sometimes with reference to relevant literature. The information regarding the condition descriptions on page 7 or 9 and on www.wormser-auktionshaus.de are part of these auction conditions. The starting price represents a subjective evaluation. The auctioneer is not liable for errors in the auction exhibits.
  5. As long as the seller/consignor and bidder/bidder do not express themselves to the contrary, they assure that they are only entitled to the catalog and the items offered therein which relate to the period from 1933 to 1945 and fall or may fall under Sections 86, 86a StGB sell and acquire for the purposes specified in Section 86 (3) of the Criminal Code. These are: civic enlightenment, defense against unconstitutional and anti-constitutional efforts, scientific and art historical research, enlightenment and reporting on current affairs or military historical and uniform research. The seller/consignor and auctioneer only offer the auction exhibits mentioned in the catalog under these conditions. With the bid, the bidder/bidder undertakes to acquire the auction exhibits only for the above reasons and not to use them in any way for propaganda purposes, in particular within the meaning of Section 86a of the Criminal Code.   6. As an obligated party under the Money Laundering Act (GwG), the auctioneer must observe the money laundering duties of care. If the auctioneer does not have these documents, no business relationship can be established with the seller/consignor and bidder.   7. The personal data specified in the forms for purchase orders, preview lists, catalog orders, advertisements and other contracts, in particular name, address, telephone number, bank details, which are necessary and necessary solely for the purpose of carrying out the contractual relationship between the auctioneer and the seller/consignor, bidder and bidder , are collected on the basis of legal authorizations.
    Any further use of the personal data and the collection of additional information requires the consent of the seller/consignor, bidder and bidder as a rule. The auctioneer, the seller/consignor, the bidder and the successful bidder undertake to maintain confidentiality about experiences, observations and business and trade secrets entrusted to them or that have otherwise become known as a result of the contractual relationship, as well as about the content of the contracts themselves. Furthermore, the auctioneer undertakes to comply with the provisions of Section 53 of the Federal Data Protection Act (BDSG).   8. Bids are to be given in writing or verbally in euros. Written bids must be received no later than one day before the auction. If bidders submit bids with a lot number and text, the lot number is always valid. The auctioneer cannot accept complaints about the submission of incorrect lot numbers. The auctioneer can reject unknown bidders if there is no collateral. The minimum increase is about 10%. The auctioneer may permit or set other rates of increase. The prices stated in the catalog are minimum prices (lower bids cannot be considered). After payment and transfer of ownership, custody is at the expense and risk of the bidder.   9. The bid is accepted if no higher bid is submitted after a bid has been called three times. Objections are to be asserted immediately; in this case a new call is made. If there are several equally high bids, the bidder who bid first will be awarded the contract. At this point, the bidder becomes the bidder. When the bid is accepted, a purchase contract is concluded between the seller/consignor, who is represented by the auctioneer, and the bidder who has been awarded the bid. Telephone bidders will be called before the desired item is called up if there is a written bid for this. The auctioneer does not guarantee that the telephone connection will be established. Shipping is via DHL at the bidder's risk.
  10. The surcharge obliges acceptance. With the acceptance of the bid, the risk with regard to the auction exhibits is transferred directly to the bidder; it is up to the successful bidder to protect themselves against the risks of loss, theft, damage or destruction of the relevant auction exhibits by taking out appropriate insurance.
  11. There is no right of withdrawal according to § 312 g BGB for publicly accessible auctions.
  12. Ownership remains with the seller/consignor until the purchase price has been paid in full. A right to return exists only after payment. Until the payment and transfer of ownership, the safekeeping takes place at the expense and risk of the bidder.
  13. On the day of the auction, bidders present must pay the auctioneer or an authorized representative the hammer price, premium and value-added tax due in cash or with a German EC card. The long-distance bidders receive an invoice for the hammer price due with the bid, premium and value added tax, which they must pay within the period stated there. The dispatch takes place after receipt of the payment at the expense and risk of the bidder. The costs for parcel shipping and packaging are calculated according to the amount of the surcharge. Since the quantity and scope of the auction exhibits to be auctioned differ for the auctioneer depending on the auction, it may take more than 14 days for the individual auction exhibits to reach the bidder.   14. The auctioneer maintains internal contractual relationships with external live internet bidding systems. As soon as a bidder/bought bidder via one of these external live internet bidding systems, e.g. B. bids live via Lot-tissimo during an auction, the auctioneer does not guarantee the technical possibility of establishing an internet connection or the timely transmission of bids. The auctioneer recommends submitting bids early in order to be sure to be considered in the auction. The examination and approval of the registration for online bidders can take up to 24 hours. If you register later than 24 hours before the start of the auction, your registration may not be processed in time. For the use of external live internet bidding systems, the live bidder pays an additional premium after the bid, e.g. B. Lot-tissimo is 3% plus VAT. The premium is paid by the auctioneer to the initiators of the respective internet live bidding system. In principle, the auction conditions of the auctioneer apply. In addition, the bidder/bidder must observe the general terms and conditions of the respective external live Internet provider.
  15. Bidders who have ticked that they will collect their auction exhibits from the auctioneer or bidders who have been awarded lots that are only for self-collection must have collected the auction exhibits from the auctioneer within four weeks, otherwise storage costs i. hv EUR 30.00 per month due.
  16. A premium i. hv 20% plus VAT charged (total 23.80%); in the case of written bidders and live bidders a premium i. hv 20% of the hammer price and EUR 1.00 per auction item. The value-added tax incurred on the commission and additional costs (1.00 Euro ticket fee, shipping costs) will be invoiced separately. Invoicing during the auction requires immediate verification due to overload.
  17. After receipt (pickup, delivery DHL) of the auction exhibits, bidders must immediately complain to the auctioneer about obvious errors or defects so that they can be forwarded to the seller/consignor. We pack according to the four-eyes principle. After the fault or defect has been determined and after consultation with the auctioneer, the auction item complained about must reach the auctioneer within 8 days at the latest. Later complaints are excluded.
  18. If the bidder is in default of payment, he has to pay interest on arrears at 1.5% per month started and storage costs of 15.00 euros per month. The bidder is free to prove that the damage has not occurred or is less than the above flat rate. After setting a deadline with the threat of rejection, he loses all rights from the bid, the auction exhibits are used at his own expense, he is liable for the loss and has no claim to the additional proceeds. The auctioneer is entitled to claim damages for non-performance i. hv 25% of the hammer price as a lump sum (because of the auctioneer's lost commission), the right to prove increased expenses is reserved, the bidder is free to prove reduced expenses.
  19. The auctioneer is entitled to collect or sue for the purchase money, purchase money arrears and/or ancillary services on behalf of third parties.
  20. Claims for damages against the auctioneer, whether due to delay, impossibility of performance, positive breach of contract, culpa in contrahendo, tort, and liability for damage caused by the auction exhibits are excluded, unless the damage was caused intentionally or through gross negligence has been evoked. The auctioneer assumes no liability for any damage caused by lot numbers glued to the auction exhibits.
  21. The large number of written bids can lead to entry errors, so that a written bidder/successful bidder has not been awarded a bid for an auction exhibit. The auctioneer expressly excludes any claims for damages in this case.
  22. The above conditions also apply to after sales. The provisions on distance selling according to §§ 312 b ff BGB do not apply.
  23. Every visitor to the auction is liable for the damage caused by him. The auctioneer exercises the domiciliary rights in all auction rooms and reserves the right to exclude people from the preview or auction without giving reasons.
  24. The auctioneer and the owner of the auction items at the time of publication of the catalog are exclusively entitled to the saleable and inheritable rights of exploitation, use and copyright to the illustrations in this catalogue. They do not pass to the bidder/bidder when they are purchased in the auction on which this catalog is based. The right to these illustrations expressly includes the duplication and publication as well as the exercise of all ancillary and consequential rights. The bidder/bidder of these auction exhibits in the context of the auction waives any rights to these illustrations. The bidder/bidder is prohibited from using the images and texts used in electronic media and the catalogue, even after the auction.
  25. The colors in the illustrations may differ from the actual color scheme. The auctioneer expressly points out that only a visual inspection can provide final security. The auctioneer cannot accept complaints about color deviations.
  26. The submission of a verbal or written bid means the acceptance of these auction conditions. These auction conditions with the condition descriptions are also part of the purchase contract.
  27. Photographing auction exhibits or people in the auctioneer's premises during the stay, during the preview or during the auction is not permitted.
  28. Telephone calls in the auction room are not permitted during the auction.
  29. Through these auction conditions, the seller/consignor, bidder and bidder agree that the auctioneer may regularly send information/advertising in digital form, e.g. e.g. newsletters, flyers (letter, e-mail/SMS, telephone, fax) and in printed form, e.g. B. catalogues, flyers (by letter or parcel).   30.   32. These auction conditions are subject to German law. The Vienna UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  33. If mandatory law requires a decision on a matter arising from or in connection with these auction conditions or its implementation by a court of law, the place of jurisdiction is Worms.
  34. Should a provision be or become void, ineffective or unenforceable in whole or in part, the validity and enforceability of all remaining provisions shall not be affected. The void, ineffective or unenforceable provision shall, to the extent permitted by law, be regarded as being replaced by the effective and enforceable provision that comes closest to the economic purpose of the void, ineffective or unenforceable provision in terms of object, size, time, place and scope . The same applies to filling any gaps in these auction conditions.
  35. In the event of discrepancies, the German version of the auction conditions always applies.
  36. All prices are given in euros.

B. Additional Provisions for Numismatic Auctions


  1. The description in the print and digital media is done conscientiously and using specialist literature, the authenticity of the pieces is guaranteed. Counterfeit auction items that are not recognized will be taken back and the purchase price reimbursed.
  2. Unless it is a bundle, the auction exhibits - especially coins and medals - are shown in their original size, unless a different scale is specified.
  3. There may be deviations in the true-to-scale and color representation of the auction exhibits in the print and digital media. The auctioneer assumes no guarantee for this. Liability is therefore excluded.
  4. If a bidder was present at the auction, all complaints are excluded. Since viewing is possible both before and during the auction, complaints regarding the grade of preservation given in the print and digital media are also excluded.
  5. Groups with several coins or medals are generally excluded from complaints based on the degree of preservation. The amounts given in the lots are approximate, so the auctioneer is not liable for any deviating numbers.
  6. If bidders hand over the coins and medals purchased from the auctioneer to a grading service, the auctioneer does not guarantee that the auction exhibits will be accepted there or that they will be classified according to the auctioneer's assessment.
