General Auction Conditions

By the submission of bids, the following Auction Conditions are recognized and accepted.

1. The auction takes place voluntarily, in the name and on behalf of the auctioneer and against immediate payment in Euro. Payment by instalments may only be granted by prior agreement with the auctioneer.

2. The lots are awarded to the highest bidder by hammer price. If two bids are identical, the first one received will take precedence. The auctioneer reserves the right to refuse to award a lot or to withdraw, recombine and divide lots. In the event of misunderstandings, the auctioneer is entitled to auction off the lots again. The minimum bid is 5 euros. Bids less than 5 euros will not be accepted.

3. Our bidding increments must be accepted. (see below "Bidding increments")
The bidding is always done in your favor. Bids not corresponding to our bidding increments are automatically increased to the next increment.

4. The buyer’s premium is 20% of the hammer price; an additional charge of 2 euros per lot plus any shipping costs. The statutory value added tax of 7% is payable in addition (applies only for customers in the EU).

5. The purchase order contract between the auctioneer and the buyer becomes valid with the knockdown. At the moment of knockdown all risks concerning losses or damage are at the responsibility of the buyer. In case of bidding for a third party, both buyer and third party are liable. Bidders receive a pre-payment invoice that is due to immediate payment. The ownership of the auctioned goods will only be transferred to the buyer when full payment has been effected.

6. The awarded lots are due to payment within 5 days upon receipt of the auction invoice. If payment has not been effected 3 weeks after the auction at the latest, the auctioneer may demand the non-performance and take legal action. (€ 5,- reminder fee and 1,5% of the invoice amount will be charged).

7. Should the obligatory acceptance be refused, the auctioneer can decide whether after a set period, compensation will be charged due to non-fulfilment. The damages can be regulated in such a manner that the lots are taken into a future auction and the debtor is charged the difference between the knockdown bid and the previous bid as well as the costs connected with this transaction, including the charges of the auctioneer. There is no demand for higher realizations.

8. The auction lots have been described carefully and conscientiously, however the auctioneer cannot be held responsible for any faults or attest the authenticity.

9. Complaints must be received no later than eight days upon receipt of the lots involved. The lots which are subject of the complaint must be submitted in their original condition and the contents must be unchanged, otherwise no complaints will be permitted.

10. The lot numbers and bids must be entered properly on the bid form and are to be rechecked for correctness by the bidders. No complaints will be accepted due to incorrect lot numbers or bids in the bid form.

11. Any claims against the supplier or the auctioneer must be received within six weeks after the auction.

12. Collections or collective lots are excluded from complaints.

13. Lots will not be shipped for previewing.

14. Until the auction takes place, the auctioned goods are locked away at our business premises at Rathausplatz 3, 79576 Weil am Rhein, Germany. The auctioned goods may be viewed at our office up to around 3 weeks before the auction, by prior telephone notification.

15. The auctioneer reserves the right to exclude people from the auction without giving any reason. The auction terms are binding for suppliers, auction participants and bidders, without written acceptance. By the submission of written bids, on issue of purchase contracts or for bidding personally at the auction, our general auction conditions are recognized and accepted.

16. The area of jurisdiction is Lörrach, Germany and the place of fulfilment is Weil am Rhein, Germany. The contract of auction is subject to German law.

Par sa participation à nos enchères, le client accepte sans restriction nos conditions de vente.

1. La vente aux enchères est volontaire et publique, contre paiement comptant. Les chèques bancaires sont acceptés. Pour les nouveaux clients: Seuls seront acceptés les chèques bancaires confirmés. Important: Pour obtenir le paiement différé de votre facture, il est IMPERATIF d’en faire la demande sur votre ordre d’achat ou personnellement.

2. L’attribution d’un lot se fait à la personne ayant formulé l’offre la plus élevée. En cas d’offre identique pour un même lot, celui-ci est adressé au premier ordre reçu en notre bureau. L‘adjudicateur se réserve le droit de retirer des lots, de les partager, de les grouper ou, en cas de malentendu, de les crier à nouveau. L’offre minimum pour un lot est 5 euros. Les offres moins de 5 euros ne sont pas acceptées.

3. Notre échelle des enchères doit être respectée. (voir ci-dessous "échelle des enchères")
Toutes les offres intermédiaires sont automatiquement arrondies au prochain échelon supérieur!

4. En sus du prix d‘adjudication, il sera perçu une commission de 20% et 2 euros par lot ainsi que les frais d‘expédition éventuels. La TVA de 7% sera calculée et perçue sur la totalité du montant.

5. L‘adjudication engage personnellement l‘acheteur. Les clients présents dans la salle payent comptant, ceux-ci qui ont misé par écrit effectuent leur paiement après réception de notre facture préalable. Les lots restent la propriété de l‘adjudicateur jusqu‘au règlement intégral de la facture.

6. Toutes les factures doivent être réglées dans les 5 jours à dater de l‘expédition. En cas de retard, un intérêt de 1,5% sera exigé par mois entamé. 3 semaines après l’envoi de la facture, le montant de la facture sera encaissé par voie légale (frais € 5,- par lettre de rappel plus un intérêt de 1,5% par mois).

7. Si le paiement n’est pas effectué immédiatement ou si l’acceptation obligatoire est refusée, l’acheteur perd ses droits à l’adjudication. Les lots peuvent être vendus à ses frais sans avis préalable ou être remis aux enchères. Dans ce cas, le premier acheteur est responsable de la perte de profit.

8. Les lots sont décrits consciencieusement, sans engager toutefois la responsabilité de l’adjudicateur.

9. Des réclamations doivent nous être soumises 8 jours après réception des lots au plus tard. Tout droit de réclamation s’éteint en cas de manipulations entraînant une modification de l’état des cartes postales.

10. Il est important de vérifier l’exactitude des numéros des lots soumissionnés afin d’éviter toute contestation lors de l’attribution qui restera irrévocable. Aucune réclamation ne sera admise pour ce motif.

11. Pour de prétendues falsifications ou réparations, l‘acheteur a six semaines à dater du jour de la vente pour prouver celles-ci au moyen d‘une attestation d‘un expert reconnu.

12. Nous n’acceptons pas des réclamations pour les collections ou les lots comprenant quatre pièces et plus.

13. Nous n’adressons pas des photocopies de nos lots pour prévoir.

14. Les lots vendus aux enchères se trouve en notre bureau à Rathausplatz 3, 79576 Weil am Rhein enfermés en sécurité jusqu’au la vente aux enchères. Les lots sont disponibles à l’examen en notre magasin où ils sont exposés durant les trois semaines précédant la vente aux enchères.

15. L‘adjudicateur peut, sans en justifier le motif, refuser des offres écrites, exclure un acheteur de la salle ou ne pas tenir compte de ses offres. Par sa participation à nos enchères, le client accepte sans restriction nos conditions de vente.

16. En cas de litige le for judiciaire est Lörrach.
