Terms and conditions of sale

1.) Bidding currency is Euro. Written bids can be submitted by post, fax, e-mail or handed personally to the auctioneer until Friday, April 8th 2011 at 16:00. Written bids received later will not be considered.

2.) The bidding increments are:

Bids, not correspodning to indicated increments will be rounded to the nearest correct step. Descriptive instructions such as 'at best' or 'at any price' will not be consideered.

3.) Unit of sale in auction is lot, each consecutive number in the catalogue is one lot.

4.) The auctioneer reserves the right to recombine or withdraw lots.

5.) Each lot will be awarded to the highest bidder at the price equal to the second highest bid plus one bidding increment. In the case of two or more identical bids, the first received bid will be awarded the lot.

6.) In addition to the winning price the buyer shall pay:

a) Commision of 20 % (VAT included) for lots liable to special taxation treatment. Such lots are clearly marked with the letter 'R' next to the starting price.

b) VAT of 8,5 % for other lots (without the letter 'R' next to the starting price). VAT will not be added for purchases by EU dealers with valid tax identification number. The VAT will also not be charged to buyers outside EC if the exportation of lots is arranged by Philadria d.o.o..

7.) The award of the lot represents a contract for purchase binding on the buyer. The physical ownership of the goods is transferred to the buyer only following the payment in full; however the risk passes onto the buyer on the award of the lot.

8.) The hall bidders are obliged pay and collect the awarded lots immediately. Mail (written) biders are obliged to pay for purchases within 14 days of the date of receipt of the invoice. If the payment is not received within this time limit the purchaser forfeits the right to buy the lot(s). Lot(s) held for personal collection on instruction of the buyer must also be collected within 14 days.

9.) Stamps are described carefully. Faults which affect the price e.g. missing perfs, brown stains et sim. are noted. For illustrated lots the picture is an integral part of description and claims relating to margins, perforation, cancellation, centering et sim. will not be considered. Any other claims must be received within 8 days of the collection or receipt of the goods.

No complaints will be considered for damaged, repaired, forged or partly forged stamps when described as such.

No complaints will be considered for large lots (3 or more stamps).

No complaints will be considered if the lots (stamps) have been altered in any way (e.g. by removal of hinges, chemical or mechanical treatment etc.)

No complaints will be considered if the lots are not paid for or collected in stipulated time.

The purchase signifies the acceptance of certificates/signatures mentioned in catalogue.

10.) Taking part in sale is entirely on voluntary basis. By entering any bid(s) the terms and conditions of sale are fully accepted

11.) The auctioneer reserves the right to exclude any person from the sale or reject his offer, without stating any reasons, in particular any person disturbing the sale or persons who have not paid for or refused to collect lots awarded in the past.

12.) Any disputes arising from the transactions based on this listing will be referred to and adjudicated by the competent Slovenian Court in Ljubljana.

The conditions of sale published in Slovene language are legally binding.

Pravila in pogoji dražbe

1.) Draženje poteka v evrih (€). Pisne ponudbe sprejemamo osebno, po pošti, faxu ali elektronski pošti do petka, 8. aprila 2011, do 16:00 ure. Za pisne ponudbe, prejete po tem terminu ne jamčimo, da bodo upoštevane.

2.) Draženje poteka po stopnjah:

Pisne ponudbe, ki niso v skladu z navedenimi stopnjami bodo zaokrožene v skladu s stopnjami draženja. Opisne ponudbe (npr. »najboljša ponudba«, »v vsakem primeru«, »za vsako ceno« in podobno) ne bodo upoštevane.

3.) Enota prodaje na dražbi je lot, obsega eno zaporedno številko v katalogu dražbe.

4.) Pridržujemo si pravico, da posamezne lote prerazporedimo, združimo v en lot ali umaknemo iz prodaje.

5.) Vsak posamezen lot bo dodeljen najboljšemu ponudniku za eno dražitveno stopnjo nad drugo najvišjo ponudbo. V primeru dveh ali več enako visokih ponudb ima prednost ponudba, ki je prispela prva.

6.) Kupec plača na doseženo (izdraženo) ceno (dodatno):

a) provizijo 20 % (ki vključuje DDV) v primeru posebne ureditve obdavčenja (obdavčitev razlike v ceni). Velja za lote označene z veliko črko R poleg izklicne cene.

b) DDV v višini 8,5 % pri lotih brez oznake poleg izklicne cene.

DDV se ne zaračuna tujim trgovcem iz EU z veljavno identifikacijsko številko za DDV. Prav tako se DDV ne zaračuna kupcem izven EU vkolikor gre za redni izvoz, ki ga izpelje Philadria d.o.o..

7.) Z izdražitvijo lota se vzpostavi med prodajalcem in kupcem kupoprodajno razmerje, ki terja od kupca (najboljšega ponudnika) plačilo in prevzem izdraženega lota. Lastništvo nad izdraženim blagom se prenese na kupca šele s plačilom polne kupnine, riziki pa že z izdražitvijo.

8.) Kupec v dvorani je dolžan plačati in prevzeti izdraženo blago takoj. Pisni ponudniki so dolžni plačati in prevzeti izdraženo blago v roku 14 dni od izdaje računa. Z zamudo plačila dražitelj izgubi pravico do izdraženega lota.

9.) Znamke v ponudbi so opisane skrbno. Poškodbe, ki lahko znižujejo ceno so posebej navedene (manjkajoči zobci, rjavi madeži in podobno). V primeru znamk in pisem, ki so v katalogu naslikane, je slika merodajna glede robov, zobcev, žiga, centriranja ipd. in je sestavni del opisa. Morebitne reklamacije upoštevamo v roku 8 dni od prejema blaga. Reklamacije so izključene v primeru poškodovanih, popravljenih, (delno) ponarejenih znamk, ki so kot takšne opisane v katalogu in velikih lotov (ki vsebujejo več kot tri znamke/pisma). Reklamacije so izključene, če so znamke spremenjene. Za spremembe štejejo mehanske in kemične poškodbe/spremembe, odstranitev falca (prilepke), ipd). Kupec izgubi pravico do reklamacije, če zamudi rok plačila. Atesti/signature ekspertov, navedeni v katalogu so z nakupom sprejeti.

10.) Sodelovanje na dražbi je prostovoljno. S posredovanjem ponudbe vsak ponudnik v celoti sprejema pogoje in pravila dražbe.

11.) Dražitelj si pridržuje pravico, da kogarkoli izključi iz dražbe, oz. zavrne njegovo ponudbo, brez navajanja razloga za to, še posebej osebe, ki motijo potek dražbe ali osebe, ki v preteklosti niso plačale in prevzele izdraženih lotov.

12.) Za morebitne spore je pristojno sodišče v Ljubljani.
